1. About these terms
These Terms of Service (“Terms”) form a contract between you and Orchid & Plum Atelier (“we”, “us”, “our”). They cover your use of opatelier.com (the “Site”) and any purchases you make through it.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to make purchases. By using the Site, you represent that you meet these requirements.
3. Account
You may create an account to manage orders, save addresses, and receive personalized recommendations. You are responsible for keeping your password secure and for all activity under your account. Notify us immediately at security@opatelier.com of any unauthorized use.
4. Orders and acceptance
All orders are offers to purchase. We reserve the right to accept or decline any order at our discretion, including for suspected fraud, pricing errors, stock availability, or shipping restrictions. Your contract with us forms only when we send the shipping confirmation email.
5. Pricing, currency, and taxes
All prices on the Site are listed in U.S. dollars (USD) unless otherwise indicated. We may change prices at any time before you place an order. Sales tax is calculated at checkout based on your shipping address. International orders may be subject to import duties and taxes assessed by the destination country’s customs authority — these are your responsibility.
6. Payment
Payment is processed securely by Stripe. We accept major credit and debit cards, Apple Pay, Google Pay, and other methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method.
7. Shipping
Shipping methods, costs, and estimated delivery times are shown at checkout. Risk of loss passes to you when we hand the parcel to the carrier. See our Shipping Policy for details.
8. Returns and refunds
You may return unworn, undamaged items in their original packaging within 30 days of delivery for a full refund (excluding original shipping costs). Final-sale items, customized pieces, and intimate apparel are not returnable. See our Returns & Refunds Policy for the full process.
9. Limited warranty
We warrant that products will be free of material defects for 90 days from delivery. Your sole remedy is repair, replacement, or refund at our discretion. To make a warranty claim, contact hello@opatelier.com with your order number and photographs of the defect.
EXCEPT FOR THE EXPRESS WARRANTIES IN THIS SECTION, ALL PRODUCTS ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
10. Intellectual property
All content on the Site — including text, photographs, logos, illustrations, and underlying code — is owned by Orchid & Plum Atelier or our licensors and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
If you submit reviews, photographs, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with our business.
11. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to any part of the Site or our systems.
- Scrape, mirror, or systematically extract content for commercial use.
- Submit false, misleading, or infringing content.
- Interfere with the Site’s operation through bots, viruses, or denial-of-service attacks.
- Resell or auction items obtained from us in a manner inconsistent with our trademark rights.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ORCHID & PLUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify and hold us harmless from any third-party claim arising from your breach of these Terms, your User Content, or your unlawful use of the Site.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
15. Changes
We may update these Terms from time to time. Material changes will be posted with a new “Last updated” date and, if significant, communicated by email to account holders. Continued use of the Site constitutes acceptance of the revised Terms.
16. Severability and entire agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any order-specific terms, constitute the entire agreement between you and us.
